Do I need to attend each and every court appearance?
If you are represented by legal counsel, then No you do not have to attend each and every court appearance. The Florida Rules of Criminal Procedure 3.220(p)(1) are available for review at no charge at This Rules provides for you to not appear if your waiver of appearance is in writing.
How will the court determine my sentence?
The State of Florida legislature has enacted Chapter 921 of the Florida Statutes which contains a mathematical formula to determine a range within which the Court must sentence you within and the form for this mathematical formula. This set of rules and the resulting score is called the Sentencing Guidelines. The basics of the formula is that most things which the State of Florida legislature thought the Court should consider in the determination of a sentence is given a number value. A total of those numbers is adjusted a couple different ways to determine a low range and a high range for the sentence which the Court may impose. There are, of course, exceptions to this range. What are the requirements to file for a dissolution of marriage in Florida?
The State of Florida requires that either the Husband or the Wife has been a resident of the State of Florida for more than six (6) months immediately preceding the filing of the dissolution of marriage proceeding. If one spouse resides in the State of Florida and the other spouse resides in a state other than Florida, may either spouse obtain a dissolution of marriage in Florida?
Yes. Only one party to the marriage has to reside in Florida for the six (6) months immediately preceding the filing of the dissolution of marriage proceeding. Read Florida Statute 61.021 and Statute 61.061 for no charge by clicking on each. However, obtaining a dissolution of marriage does not necessarily mean that all issues you need addressed will be resolved. For instance, the Court may have jurisdiction to simply say that you are no longer married but may not have jurisdiction to decide issues regarding your children, to award alimony, etc...
How will the Court determine my child support obligation?
The State of Florida legislature has enacted Florida Statute 61.30 which contains a mathematical formula to determine each parties’ child support obligation. Yes, I said each parties’ child support obligation as both parents have the legal obligation to pay child support. 61.30 basically states, for child support purposes only, what is considered to be income, what is considered to be a deduction from income, and a reference chart for the basic child support obligation. How will the Court determine my alimony obligation?
The Court must first establish a right to alimony. Then the Court must determine the need for alimony followed by the ability of the other party to pay alimony. In this determination, the Court must follow Florida Statute 61.08. However, unlike child support, there are no real guidelines to assist the Court in a determination of an amount of alimony.
